EU-based manufacturers, importers and rebranders of electrical and electronic equipment or batteries, as well as online shops selling these products to the European Union fall under the mandatory obligations of the WEEE and Battery Directive.

PV CYCLE is a member-based non-profit organization offering collective and tailor-made waste management and legal compliance solutions under the WEEE and Battery Directives. We enable the responsible parties to comply with their mandatory obligations – in an easy and cost-effective way.

Under the WEEE regulations, a ‘Producer’ and thus the legal responsible is defined as:

MANUFACTURER

Any natural or legal person established in a country of the European Union and manufacturing and selling under his own name or trademark within the territory of this Member State

REBRANDER

Any natural or legal person established in a country of the European Union and reselling products produced by other suppliers (except where the brand of the original producer appears on the product) within the territory of this Member State under his own name or trademark.

IMPORTER

Any natural or legal person established in a country of the European Union and placing products from a third country or from another Member State on the market of this Member State

ONLINE SALES SHOPS 

Companies established in another EU-27 Member State or in a third country and selling products online directly to end customers in a EU-27.

They must appoint an Authorized Representative, which then represents the foreign based legal entity in that country of the EU-27.

OBLIGATIONS: WEEE

  • Organize and finance the take-back and treatment of your products
  • Register the company at the national Producers register
  • Periodically report to the national register the quantity of sold products
  • Inform the users on correct waste disposal
  • Mark the products with a crossed-out wheelie bin
  • Ensure a financial guarantee (country-specific)
  • Mark the products with your identification mark (brand, logo, …)
  • Inform treatment facilities of product’s composition and use of hazardous materials

OBLIGATIONS: BATTERY

  • Organize and finance the take-back and treatment of your products
  • Register the company at the national Producers register
  • Periodically report to the national register the quantity of sold products
  • Inform the users on correct waste disposal
  • Mark the products with a crossed-out wheelie bin
